Wine and Sonos Offer Terms and Conditions

Who is running the offer?
The Promoter is Treasury Wine Estates Australia Limited (ABN 78 145 321 320), 58-82 Queensbridge Street, Southbank Vic 3006. Phone: (03) 8533 3000.

When will the offer start and end?
The purchase period for the offer starts at 12.01am (AEST) on 11/06/18 and ends at 11.59pm (AEST) on 07/08/18 or when Promo Codes run out, whichever occurs sooner (the Purchase Period).
The claim period for the offer starts at the start of the Purchase Period and ends at 11.59pm (AEST) on 14/08/18 or when Promo Codes run out, whichever occurs sooner (the Claim Period).
Sonos One smart speakers purchased in relation to this offer must be purchased in accordance with these Terms and Conditions by 11.59pm (AEST) on 30/09/18.

Who can claim?
Only Australian residents aged 18 or over can claim.

Where will the offer run?
The offer will run in all Australian liquor licensed outlets, including online retailers, (Outlets) which are selling Eligible Wines for off-premise consumption.
For the avoidance of doubt, an Outlet is a bottle shop or online retailer selling wine for off-premise consumption.

Do I need to buy anything to claim?
Eligible Wines: Penfolds Max’s, Penfolds Bins, Penfolds Koonunga Hill, Wolf Blass Gold Label/Grey Label/Brown Label/Blass/Blass Reserve/Blass Noir/Altitude (all other Wolf Blass ranges excluded), Pepperjack, The Stag by St Huberts (all other St Huberts wines excluded), Wynns, Samuel Wynn & Co, Gentleman’s Collection,19 Crimes, Devil's Lair (Fifth Leg excluded), Coldstream Hills, Squealing Pig, Seppelt, Sterling, Black Grape Society and Rosemount 7 Trick Pony (all other Rosemount wines excluded).
During the Purchase Period you need to buy at retail from an Outlet, Eligible Wines for off-premise consumption in any combination in a single transaction for a total purchase price of $80 or more (includes online purchases) (a Qualifying Purchase), to have the opportunity to purchase a Sonos One smart speaker for the discounted price of $149 (recommended retail price (RRP) $299), while stocks last.
There are a total of 4,000 Sonos One smart speakers available for purchase at the discounted price, in accordance with these Terms and Conditions.
The Qualifying Purchase spend is calculated based on the amount spent in the transaction with the Outlet, as evidenced by the purchase receipt (and not the RRP or shelf price).

Claim instructions
After you have made a Qualifying Purchase, you must during the Claim Period while stocks last, obtain a unique single use promotional code (Promo Code), which can be used to purchase a Sonos One smart speaker by 11.59pm (AEST) on 30/09/18 for the discounted price of $149 (RRP $299), while stocks last.
To obtain a Promo Code, you must during the Claim Period after you have made a Qualifying Purchase, while Promo Code stocks last:
(a) visit;
(b) upload an image of your Qualifying Purchase receipt which must clearly identify the Outlet of purchase (which must be a participating Outlet), the product/s purchased (which must comprise a Qualifying Purchase) and the date of purchase (which must be during the Purchase Period before you submitted your claim); and
(c) fill out and submit the online claim form by providing all requested information.
After completing steps (a) to (c) above, you will be notified by email confirming whether or not your claim has been verified as successful within 3 business days of the Promoter receiving your claim. The Promoter may, in its absolute discretion, require you to provide further details, information or documentation within a specified time period in order to verify a claim.
The above steps must be completed in their entirety by 11.59pm (AEST) on 14/08/18.
If your claim is verified as successful, you will receive a Promo Code via the email address provided in (c) above within 1 business day of being verified and must follow the Speaker purchase details below to purchase your Sonos One smart speaker by 11.59pm (AEST) on 30/09/18.
If your claim is deemed to be unsuccessful for any reason, including if the Promo Codes available to claim have been exhausted, the Promoter will advise you via the email address provided in (c) above.

Speaker purchase details
After you have received a Promo Code from the Promoter, you must by 11.59pm (AEST) on 30/09/18:
(a) visit (the Sonos Website); and
(b) follow the instructions at the Sonos Website to purchase a Sonos One smart speaker for the discounted price of $149 (RRP $299) by entering the Promo Code, making your payment and providing all requested details.
Sonos One smart speakers will be shipped by Sonos to claimants in accordance with Sonos' standard shipping terms. All purchases made at the Sonos Website are subject to any additional terms which apply to purchases made at the Sonos Website.

Total value
There are a total of up to 4,000 Promo Codes available, with each equating to a Sonos One smart speaker available for purchase at the discounted price of $149 (RRP $299). The discounted price represents a saving of $150 per Sonos One smart speaker, compared to the RRP.
The RRP value of all Sonos One smart speakers available is $1,196,000 (4,000 x $299). The total potential savings, compared to the RRP, on all Sonos One smart speakers available is $600,000 (4,000 x $150).

How many times can I claim?
You can claim a maximum of one Promo Code per person (equating to one discounted Sonos One smart speaker per person) and there is a maximum of one claim per Qualifying Purchase and per receipt. Each claim must be submitted separately in accordance with these Terms and Conditions.
You must only obtain a Promo Code and Sonos One smart speaker for personal use and must not purchase (or attempt to purchase) for any other purpose, including reselling.

Must I keep anything to verify my claim?
You must keep the original itemised purchase receipt for your claim as proof of purchase. If you don't produce the proof of purchase for your claim when asked the Promoter may disqualify your claim. The purchase receipt must be identical to the image uploaded by you with your claim. If, in the Promoter's opinion, you have shared any receipt/s with another person, your claim/s and participation in this offer will be invalid.

1 These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about Sonos products and how to claim forms part of these Terms and Conditions. By claiming, you accept these Terms and Conditions.

2 Your claim must be received during the Claim Period. Your claim is deemed to be received only when received by the Promoter’s database. If you return a product comprising a Qualifying Purchase so as to mean that you have no longer made a Qualifying Purchase, your claim may be deemed invalid at the Promoter's discretion (unless product is defective). The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with claiming. If you claim using automatically generated claims or multiple aliases you may be disqualified.

3 If you are a successful claimant you must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You consent to the Promoter using your name and image in any promotional or advertising activity.

4 If you or your claim are deemed by the Promoter to breach these Terms and Conditions, your claim may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your claim (including documentation establishing your identity, age and place of residence and that any Sonos One smart speaker has been purchased, or will be purchased, for personal use). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

5 You must not:
(a) tamper with the claim process;
(b) engage in any conduct that may jeopardise the fair and proper conduct of the offer;
(c) act in a disruptive, annoying, threatening, abusive or harassing manner;
(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this offer;
(e) breach any law; or
(f) behave in a way that is otherwise inappropriate.

6 The Promoter is not liable for claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.

7 The Promoter’s decision in connection with all aspects of this offer is final.

8 A Promo Code cannot be transferred or exchanged nor redeemed for cash. The RRP value is correct as at the date of preparing these Terms and Conditions and includes any applicable GST. The Promoter is not responsible for any change in value.

9 If this offer cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the offer or disqualify affected claims/claimants, subject to approval by the state and territory gaming authorities if required.

10 The Promoter is not responsible for any tax implications arising from you receiving a Sonos product or a discount on a Sonos product. You should seek independent financial advice. If for GST purposes this offer results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

11 Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).

12 Subject to the previous paragraph, the Promoter and the agencies and companies associated with this offer are not liable (including in negligence) for any loss (including indirect, special or consequential loss, loss of opportunity or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this offer or any Sonos product, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).

13 The Promoter may communicate or advertise this offer using Facebook, Instagram and other social media platforms. However the offer is in no way sponsored, endorsed or administered by, or associated with, any social media platform. You provide your information to the Promoter and not to any social media platform. You completely release all social media platforms from any and all liability.

14 Enjoy alcohol responsibly. Consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol ( Participation in this offer is subject to the relevant Outlet’s liquor serving policy.

Collection and use of your personal information
15 The information you provide will be used by the Promoter for the purpose of conducting this offer. The Promoter may collect your personal information (including through its contractors or agents) or disclose your personal information to its contractors, agents and suppliers to assist in conducting this offer, communicating with you or delivering your Promo Code. By claiming this offer, you consent to the storage of your personal information on the Promoter’s database and the Promoter may use this information for future offer and marketing purposes regarding its products, including contacting you via electronic messaging. By claiming this offer, you consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the Privacy Principles in the Privacy Act 1988. You can request access to the personal information the Promoter holds about you by contacting the Promoter at the address stated in the Promoter section of these conditions. The Promoter’s Privacy Policy, located at, contains information about:
(a) how you can seek access to the personal information the Promoter holds about you and seek the correction of such information;
(b) how you can complain about a privacy breach and how the Promoter will deal with such a complaint; and
(c) whether the personal information the Promoter holds about you will be provided to overseas companies, and if so, in which countries those companies are located.
